(1) For the purpose of determining compliance with any rule or any performance or payment obligation under a lease, permit, or contract, the division may, at reasonable times, places, and intervals:

Terms Used In Utah Code 65A-1-11

  • Contract: A legal written agreement that becomes binding when signed.
  • Division: means the Division of Forestry, Fire, and State Lands. See Utah Code 65A-1-1
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
     (1)(a) require that the lessee, permittee, or contractor provide any pertinent books, records, or other documents of the lessee, permittee, or contractor; or
     (1)(b) inspect the property acquired, used, or developed under the lease, permit, or contract after reasonable notice or as provided in the lease, permit, or contract.
(2) Nothing in the section shall be construed to limit or invalidate audits conducted by the division prior to the effective date of this act.
