As used in this title:

(1) “Commissioner” means the commissioner of the department.

Terms Used In Utah Code 70D-1-102

  • Commissioner: means the commissioner of the department. See Utah Code 70D-1-102
  • Contract: A legal written agreement that becomes binding when signed.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Department: means the Department of Financial Institutions. See Utah Code 70D-1-102
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage: means a mortgage or deed of trust affecting real property located in this state. See Utah Code 70D-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • real property: includes :
         (31)(a) land;
         (31)(b) a tenement;
         (31)(c) a hereditament;
         (31)(d) a water right;
         (31)(e) a possessory right; and
         (31)(f) a claim. See Utah Code 68-3-12.5
  • State: means :
         (10)(a) a state, territory, or possession of the United States;
         (10)(b) the District of Columbia; or
         (10)(c) the Commonwealth of Puerto Rico. See Utah Code 70D-1-102
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
(2) “Department” means the Department of Financial Institutions.
(3) “Depository institution” is as defined in Section 7-1-103.
(4) “Dwelling” means a residential structure attached to real property that contains one to four units including any of the following if used as a residence:

     (4)(a) a condominium unit;
     (4)(b) a cooperative unit;
     (4)(c) a manufactured home; or
     (4)(d) a house.
(5) “Mortgage” means a mortgage or deed of trust affecting real property located in this state.
(6)

     (6)(a) “Mortgage loan” means a loan:

          (6)(a)(i) secured by a mortgage; and
          (6)(a)(ii) made for personal, family, or household purposes.
     (6)(b) “Mortgage loan” does not include a loan:

          (6)(b)(i) made by an individual to a member of the individual’s family; or
          (6)(b)(ii) subject to Title 70C, Utah Consumer Credit Code.
(7) “Mortgagor” means a person who:

     (7)(a) executes a mortgage; or
     (7)(b) is obligated to pay a mortgage loan.
(8) “Record” means information that is:

     (8)(a) inscribed on a tangible medium; or
     (8)(b) stored in an electronic or other medium and is retrievable in perceivable form.
(9) “Real estate brokerage activity” means an act that involves offering or providing real estate brokerage services to the public, including:

     (9)(a) acting as a real estate principal broker, associate broker, or sales agent, as defined in Section 61-2f-102, for a buyer, seller, lessor, or lessee of real property;
     (9)(b) bringing together parties interested in the sale, purchase, lease, rental, or exchange of real property;
     (9)(c) negotiating, on behalf of a party, a portion of a contract relating to the sale, purchase, lease, rental, or exchange of real property, other than in connection with providing financing with respect to the transaction;
     (9)(d) engaging in an act for which a person engaged in the activity is required to be registered or licensed as a real estate agent or real estate broker under applicable law; and
     (9)(e) offering to engage in an activity, or act in a capacity, described in Subsections (9)(a) through (d).
(10) “State” means:

     (10)(a) a state, territory, or possession of the United States;
     (10)(b) the District of Columbia; or
     (10)(c) the Commonwealth of Puerto Rico.
