Terms Used In Utah Code 73-2-1.6

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
     (1)(a) “Account” means the Water Rights Restricted Account created by this section.
     (1)(b) “Division” means the Division of Water Rights.
(2) There is created in the General Fund a restricted account known as the “Water Rights Restricted Account.”
(3) The account shall consist of the money deposited into the account under Subsection 59-12-103(5)(e).
(4) Upon appropriation, the division may use money in the account for:

     (4)(a) costs incurred by the division that benefit water rights adjudications, including:

          (4)(a)(i) employing technical staff;
          (4)(a)(ii) acquiring equipment;
          (4)(a)(iii) obtaining legal support;
          (4)(a)(iv) conducting studies;

               (4)(a)(iv)(A) installing, operating, and maintaining measurement infrastructure; and
               (4)(a)(iv)(B) sharing the costs of installed United States Geological Survey stream gauges; and
     (4)(b) not to exceed 5% of the money deposited into the account under Subsection 59-12-103(5)(e) in the fiscal year preceding the fiscal year of appropriation, costs incurred by the division to acquire, manage, and analyze surface and groundwater data, not limited to geographic areas of adjudication.

     (5)(a) The account may not exceed $8,000,000 at the end of a fiscal year.
     (5)(b) If the account exceeds $8,000,000 at the end of a fiscal year, the Division of Finance shall deposit into the Water Resources Conservation and Development Fund, created in Section 73-10-24, the money in excess of the amount necessary to maintain the account balance at $8,000,000.
