Utah Code 17-27a-203. Notice of intent to prepare a general plan or comprehensive general plan amendments in certain counties

(1) Before preparing a proposed general plan or a comprehensive general plan amendment, each county of the first or second class shall provide 10 calendar days notice of the county’s intent to prepare a proposed general plan or a comprehensive general plan amendment:

- Affected entity: means a county, municipality, special district, special service district under Title 17D, Chapter 1, Special Service District Act, school district, interlocal cooperation entity established under Title 11, Chapter 13, Interlocal Cooperation Act, specified property owner, property owner's association, public utility, or the Department of Transportation, if:(3)(a) the entity's services or facilities are likely to require expansion or significant modification because of an intended use of land;(3)(b) the entity has filed with the county a copy of the entity's general or long-range plan; or(3)(c) the entity has filed with the county a request for notice during the same calendar year and before the county provides notice to an affected entity in compliance with a requirement imposed under this chapter. - Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- General plan: means a document that a county adopts that sets forth general guidelines for proposed future development of:
(20)(a) the unincorporated land within the county; or(20)(b) for a mountainous planning district, the land within the mountainous planning district. See Utah Code 17-27a-103- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
(1)(a) to each affected entity;(1)(b) to the Utah Geospatial Resource Center created in Section 63A-16-505;(1)(c) to the association of governments, established pursuant to an interlocal agreement under Title 11, Chapter 13, Interlocal Cooperation Act, of which the county is a member; and(1)(d) for the county, as a class A notice under Section 63G-30-102, for at least 10 days.(2) Each notice under Subsection (1) shall:(2)(a) indicate that the county intends to prepare a general plan or a comprehensive general plan amendment, as the case may be;(2)(b) describe or provide a map of the geographic area that will be affected by the general plan or amendment;(2)(c) be sent by mail, e-mail, or other effective means;(2)(d) invite the affected entities to provide information for the county to consider in the process of preparing, adopting, and implementing a general plan or amendment concerning:(2)(d)(i) impacts that the use of land proposed in the proposed general plan or amendment may have; and(2)(d)(ii) uses of land within the county that the affected entity is considering that may conflict with the proposed general plan or amendment; and(2)(e) include the address of an Internet website, if the county has one, and the name and telephone number of an individual where more information can be obtained concerning the county’s proposed general plan or amendment.
