Terms Used In Utah Code 17B-1-502

  • Municipal: means of or relating to a municipality. See Utah Code 17B-1-102
  • Municipality: means a city or town. See Utah Code 17B-1-102
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Special district: means a limited purpose local government entity, as described in Section 17B-1-103, that operates under, is subject to, and has the powers described in:
         (31)(a) this chapter; or
         (31)(b)
              (31)(b)(i) this chapter; and
              (31)(b)(ii)
                   (31)(b)(ii)(A) Chapter 2a, Part 1, Cemetery Maintenance District Act;
                   (31)(b)(ii)(B) Chapter 2a, Part 2, Drainage District Act;
                   (31)(b)(ii)(C) Chapter 2a, Part 3, Fire Protection District Act;
                   (31)(b)(ii)(D) Chapter 2a, Part 4, Improvement District Act;
                   (31)(b)(ii)(E) Chapter 2a, Part 5, Irrigation District Act;
                   (31)(b)(ii)(F) Chapter 2a, Part 6, Metropolitan Water District Act;
                   (31)(b)(ii)(G) Chapter 2a, Part 7, Mosquito Abatement District Act;
                   (31)(b)(ii)(H) Chapter 2a, Part 8, Public Transit District Act;
                   (31)(b)(ii)(I) Chapter 2a, Part 9, Service Area Act;
                   (31)(b)(ii)(J) Chapter 2a, Part 10, Water Conservancy District Act;
                   (31)(b)(ii)(K) Chapter 2a, Part 11, Municipal Services District Act; or
                   (31)(b)(ii)(L) Chapter 2a, Part 13, Infrastructure Financing Districts. See Utah Code 17B-1-102
     (1)(a) An area within the boundaries of a special district may be withdrawn from the special district only as provided in this part or, if applicable, as provided in Chapter 2a, Part 11, Municipal Services District Act.
     (1)(b) Except as provided in Subsections (2) and (3), the inclusion of an area of a special district within a municipality because of a municipal incorporation under Title 10, Chapter 2a, Municipal Incorporation, or a municipal annexation or boundary adjustment under Title 10, Chapter 2, Part 4, Annexation, does not affect the requirements under this part for the process of withdrawing that area from the special district.

     (2)(a) An area within the boundaries of a special district is automatically withdrawn from the special district by the annexation of the area to a municipality or the adding of the area to a municipality by boundary adjustment under Title 10, Chapter 2, Part 4, Annexation, if:

          (2)(a)(i) the special district provides:

               (2)(a)(i)(A) fire protection, paramedic, and emergency services; or
               (2)(a)(i)(B) law enforcement service;
          (2)(a)(ii) an election for the creation of the special district was not required because of Subsection 17B-1-214(3)(d) or (g); and
          (2)(a)(iii) before annexation or boundary adjustment, the boundaries of the special district do not include any of the annexing municipality.
     (2)(b) The effective date of a withdrawal under this Subsection (2) is governed by Subsection 17B-1-512(2)(b).

     (3)(a) Except as provided in Subsection (3)(c) or (d), an area within the boundaries of a special district located in a county of the first class is automatically withdrawn from the special district by the incorporation of a municipality whose boundaries include the area if:

          (3)(a)(i) the special district provides municipal services, as defined in Section 17B-2a-1102, excluding fire protection, paramedic, emergency, and law enforcement services;
          (3)(a)(ii) an election for the creation of the special district was not required because of Subsection 17B-1-214(3) (g); and
          (3)(a)(iii) the legislative body of the newly incorporated municipality:

               (3)(a)(iii)(A) adopts a resolution no later than 180 days after the effective date of incorporation approving the withdrawal that includes the legal description of the area to be withdrawn; and
               (3)(a)(iii)(B) delivers a copy of the resolution to the board of trustees of the special district.
     (3)(b) The effective date of a withdrawal under this Subsection (3) is governed by Subsection 17B-1-512(2)(a).
     (3)(c) Section 17B-1-505 governs the withdrawal of an incorporated area within a county of the first class if:

          (3)(c)(i) the special district from which the area is withdrawn provides:

               (3)(c)(i)(A) fire protection, paramedic, and emergency services;
               (3)(c)(i)(B) law enforcement service; or
               (3)(c)(i)(C) municipal services, as defined in Section 17B-2a-1102;
          (3)(c)(ii) an election for the creation of the special district was not required under Subsection 17B-1-214(3)(d) or (g); and
          (3)(c)(iii) for a special district that provides municipal services, as defined in Section 17B-2a-1102, excluding fire protection, paramedic, emergency, and law enforcement services, the 180-day period described in Subsection (3)(a)(iii)(A) is expired.
     (3)(d) An area may not be withdrawn from a special district that provides municipal services, as defined in Section 17B-2a-1102, excluding fire protection, paramedic, emergency, and law enforcement services, ifthe area is within a converted municipality, as defined in Section 10-1-201.5.
