(1) There is created a restricted account within the General Fund known as the “Wildlife Resources Account.”

Terms Used In Utah Code 23A-3-201

  • Big game: means species of hoofed protected wildlife. See Utah Code 23A-1-101
  • Contract: A legal written agreement that becomes binding when signed.
  • Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Proclamation: means the publication that is:
         (41)(a) used to convey a statute, rule, policy, or pertinent information related to wildlife; and
         (41)(b) issued in accordance with a rule made by the Wildlife Board under this title. See Utah Code 23A-1-101
  • Wildlife: means :
         (61)(a) crustaceans, including brine shrimp and crayfish;
         (61)(b) mollusks; and
         (61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101
  • Wildlife Board: means the board created in Section 23A-2-301. See Utah Code 23A-1-101
(2) The following money shall be deposited into the Wildlife Resources Account:

     (2)(a) revenue from the sale of licenses, permits, tags, and certificates of registration issued under this title or a rule or proclamation of the Wildlife Board, except as otherwise provided by this title;
     (2)(b) revenue from the sale, lease, rental, or other granting of rights of real or personal property acquired with revenue specified in Subsection (2)(a);
     (2)(c) revenue from fines and forfeitures for violations of this title or a rule, proclamation, or order of the Wildlife Board, minus court costs not to exceed the schedule adopted by the Judicial Council;
     (2)(d) revenue deposited into the fund under Chapter 11, Part 5, Big Game Byproduct;
     (2)(e) money appropriated from the General Fund by the Legislature pursuant to Section 23A-4-306;
     (2)(f) other money received by the division under this title, except as otherwise provided by this title; and
     (2)(g) interest, dividends, or other income earned on account money.
(3) Money in the Wildlife Resources Account shall be used for the administration of this title.
(4) At the close of a fiscal year, the unexpended balance in the Wildlife Resources Account shall convert back into the Wildlife Resources Account for the following fiscal year, except for money:

     (4)(a) legally obligated by contract;
     (4)(b) designated for capital outlay projects; or
     (4)(c) required for a program extending beyond the close of the fiscal year.
