(1) A member of the United States Armed Forces or public health or public safety organization who is mobilized or deployed on order in the interest of national defense or emergency and is precluded from using a purchased license, certificate, tag, or permit, may, as provided in Subsection (2):

Terms Used In Utah Code 23A-4-301

  • Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
  • Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
  • Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
  • Person: means an individual, association, partnership, government agency, corporation, or an agent of the individual, association, partnership, government agency, or corporation. See Utah Code 23A-1-101
  • Tag: means a card, label, or other paper-based or electronic means of identification used to document harvest of protected wildlife. See Utah Code 23A-1-101
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Wildlife: means :
         (61)(a) crustaceans, including brine shrimp and crayfish;
         (61)(b) mollusks; and
         (61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101
     (1)(a) receive a refund from the division; and
     (1)(b) if the person has drawn a permit, have the opportunities to draw that permit in a future draw reinstated.
(2) To qualify, the person or a legal representative shall:

     (2)(a) notify the division within a reasonable amount of time that the person is applying for a refund;
     (2)(b) surrender the license, certificate, tag, or permit to the division; and
     (2)(c) furnish satisfactory proof to the division that the person:

          (2)(c)(i) is a member of:

               (2)(c)(i)(A) the United States Armed Forces;
               (2)(c)(i)(B) a public health organization; or
               (2)(c)(i)(C) a public safety organization; and
          (2)(c)(ii) was precluded from using the license, certificate, tag, or permit as a result of being called to active duty.
(3) The Wildlife Board may make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, necessary to administer this section including allowing retroactive refund to September 11, 2001.
