(1) An individual while hunting a species of big game shall wear, on the exterior so the item can be seen, one or more of the following items that are primarily hunter orange material, except as provided in Subsection (2):

Terms Used In Utah Code 23A-11-205

  • Big game: includes deer, elk, big horn sheep, moose, mountain goats, pronghorn. See Utah Code 23A-11-101
  • Centerfire rifle hunt: means a hunt for which a hunter may use a centerfire rifle, except as provided in Subsection (3)(b). See Utah Code 23A-11-101
  • Director: means the director of the division appointed under Section 23A-2-202. See Utah Code 23A-1-101
  • Game: means wildlife normally pursued, caught, or taken by sporting means for human use. See Utah Code 23A-1-101
  • Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • Wildlife: means :
         (61)(a) crustaceans, including brine shrimp and crayfish;
         (61)(b) mollusks; and
         (61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101
     (1)(a) a hat;
     (1)(b) a shirt;
     (1)(c) a jacket;
     (1)(d) a coat;
     (1)(e) a vest; or
     (1)(f) a sweater.
(2) An individual is not required to wear a hunter orange item described in Subsection (1):

     (2)(a) during the following types of hunts, unless a centerfire rifle hunt is in progress in the same area:

          (2)(a)(i) archery;
          (2)(a)(ii) muzzle-loader;
          (2)(a)(iii) mountain goat;
          (2)(a)(iv) bighorn sheep;
          (2)(a)(v) bison; or
          (2)(a)(vi) moose; or
     (2)(b) as provided by a rule of the Wildlife Board made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
(3)

     (3)(a) The director may regulate the wearing of hunter orange by an individual who is:

          (3)(a)(i) not hunting, such as a hiker, camper, or other recreational user; and
          (3)(a)(ii) accessing a wildlife management area while a centerfire rifle hunt for big game is in progress on the wildlife management area.
     (3)(b) Notwithstanding Subsection (3)(a), the director may not regulate the wearing of hunter orange under this Subsection (3) by a landowner owning land inside a wildlife management area or by the landowner’s immediate family members.
(4) An individual engaged in agriculture activities is not subject to the requirements to wear hunter orange under this section.
