(1) To insure debtors of a creditor, a group life insurance policy may be issued to a policyholder who is any of the following:

Terms Used In Utah Code 31A-22-506

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Creditor: means a person, including an insured, having a claim, whether:
         (39)(a) matured;
         (39)(b) unmatured;
         (39)(c) liquidated;
         (39)(d) unliquidated;
         (39)(e) secured;
         (39)(f) unsecured;
         (39)(g) absolute;
         (39)(h) fixed; or
         (39)(i) contingent. See Utah Code 31A-1-301
  • Insurance: includes :
              (96)(b)(i) a risk distributing arrangement providing for compensation or replacement for damages or loss through the provision of a service or a benefit in kind;
              (96)(b)(ii) a contract of guaranty or suretyship entered into by the guarantor or surety as a business and not as merely incidental to a business transaction; and
              (96)(b)(iii) a plan in which the risk does not rest upon the person who makes an arrangement, but with a class of persons who have agreed to share the risk. See Utah Code 31A-1-301
  • Insured: means a person to whom or for whose benefit an insurer makes a promise in an insurance policy and includes:
              (103)(a)(i) a policyholder;
              (103)(a)(ii) a subscriber;
              (103)(a)(iii) a member; and
              (103)(a)(iv) a beneficiary. See Utah Code 31A-1-301
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Policy: includes a service contract issued by:
              (150)(b)(i) a motor club under Chapter 11, Motor Clubs;
              (150)(b)(ii) a service contract provided under Chapter 6a, Service Contracts; and
              (150)(b)(iii) a corporation licensed under:
                   (150)(b)(iii)(A) Chapter 7, Nonprofit Health Service Insurance Corporations; or
                   (150)(b)(iii)(B) Chapter 8, Health Maintenance Organizations and Limited Health Plans. See Utah Code 31A-1-301
  • Policyholder: means a person who controls a policy, binder, or oral contract by ownership, premium payment, or otherwise. See Utah Code 31A-1-301
  • Premium: includes , however designated:
              (156)(b)(i) an assessment;
              (156)(b)(ii) a membership fee;
              (156)(b)(iii) a required contribution; or
              (156)(b)(iv) monetary consideration. See Utah Code 31A-1-301
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • under common control: means the direct or indirect possession of the power to direct or cause the direction of the management and policies of a person. See Utah Code 31A-1-301
     (1)(a) the creditor;
     (1)(b) the creditor’s parent holding company; or
     (1)(c) trustees or agents designated by two or more creditors.
(2) A policy described in Subsection (1) is subject to the requirements of this Subsection (2).

     (2)(a)

          (2)(a)(i) The persons eligible for insurance are:

               (2)(a)(i)(A) all of the debtors of the creditors; or
               (2)(a)(i)(B) all of any classes of debtors.
          (2)(a)(ii) The policy may provide that “debtors” includes:

               (2)(a)(ii)(A) borrowers of money, or purchasers or lessees of goods, services, property, rights, or privileges for which payment is arranged through a credit transaction; and
               (2)(a)(ii)(B) the debtors of one or more affiliated corporations, proprietorships, or partnerships under common control with the policyholder.
     (2)(b)

          (2)(b)(i) The premiums shall be paid by the policyholder, from:

               (2)(b)(i)(A) the creditor’s funds;
               (2)(b)(i)(B) charges collected from the insured debtors; or
               (2)(b)(i)(C) from both Subsections (2)(b)(i)(A) and (B).
          (2)(b)(ii) Except as provided under Section 31A-22-512, a policy on which no part of the premium is contributed by insured debtors specifically for their insurance shall insure all eligible debtors.
     (2)(c)

          (2)(c)(i) To the extent of the creditor’s interest, the insurance may be payable to the creditor or to any successor to the right, title, and interest of the creditor.
          (2)(c)(ii) The payment shall reduce or extinguish the obligation of the debtor to the extent of the payment.
          (2)(c)(iii) When the amount of insurance exceeds the debt, the excess is payable to a beneficiary other than the creditor named by the debtor, or to the debtor’s estate.
     (2)(d) Group policies issued under this section are not subject to Sections 31A-22-516 through 31A-22-521.
