(1) Licenses issued under this chapter shall be in the form the commissioner prescribes and shall set forth:

Terms Used In Utah Code 31A-26-209

  • Agency: means :
         (6)(a) a person other than an individual, including a sole proprietorship by which an individual does business under an assumed name; and
         (6)(b) an insurance organization licensed or required to be licensed under Section 31A-23a-301, 31A-25-207, or 31A-26-209. See Utah Code 31A-1-301
  • Form: means one of the following prepared for general use:
              (74)(a)(i) a policy;
              (74)(a)(ii) a certificate;
              (74)(a)(iii) an application;
              (74)(a)(iv) an outline of coverage; or
              (74)(a)(v) an endorsement. See Utah Code 31A-1-301
  • Independent adjuster: means an insurance adjuster required to be licensed under Section 31A-26-201, who engages in insurance adjusting as a representative of one or more insurers. See Utah Code 31A-26-102
  • License: includes a certificate of authority issued to an insurer. See Utah Code 31A-1-301
  • Organization: includes a sole proprietorship by which a natural person does business under an assumed name. See Utah Code 31A-26-102
  • Public adjuster: means a person required to be licensed under Section 31A-26-201, who engages in insurance adjusting as a representative of insureds and claimants under insurance policies. See Utah Code 31A-26-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) the name, address, and the one or more telephone numbers of the licensee;
     (1)(b) the license classifications under Section 31A-26-204;
     (1)(c) the date of license issuance; and
     (1)(d) any other information the commissioner considers advisable.
(2) An adjuster doing business under any other name than the adjuster’s legal name shall notify the commissioner prior to using the assumed name in this state.

     (3)(a) An organization shall be licensed as an agency if the organization acts as:

          (3)(a)(i) an independent adjuster; or
          (3)(a)(ii) a public adjuster.
     (3)(b) The agency license issued under Subsection (3)(a) shall set forth the names of all natural persons licensed under this chapter who are authorized to act in those capacities for the organization in this state.
