Terms Used In Utah Code 41-27-201

  • Division: means the Motor Vehicle Division. See Utah Code 41-27-101
  • Novel vehicle: means a vehicle:
         (3)(a) that is not expressly exempt from registration; and
         (3)(b)
              (3)(b)(i) that does not fit within a vehicle category;
              (3)(b)(ii) with unique characteristics that make it unclear whether the vehicle fits within a vehicle category; or
              (3)(b)(iii) that a reasonable person would not consider the vehicle to be clearly included in an existing vehicle category. See Utah Code 41-27-101
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Vehicle: means a motor vehicle, combination of vehicles, trailer, semitrailer, vintage vehicle, restored-modified vehicle, off-highway vehicle, vessel, or park model recreational vehicle. See Utah Code 41-27-101
  • Vehicle category: means a vehicle type:
              (5)(a)(i) that is defined in this title or Title 73, Chapter 18, State Boating Act; and
              (5)(a)(ii) for which registration is required under:
                   (5)(a)(ii)(A) this chapter;
                   (5)(a)(ii)(B) Chapter 1a, Motor Vehicle Act;
                   (5)(a)(ii)(C) Chapter 22, Off-highway Vehicles; or
                   (5)(a)(ii)(D) Title 73, Chapter 18, State Boating Act. See Utah Code 41-27-101
  • VIN: means a vehicle identification number or a hull identification number. See Utah Code 41-27-101
(2) The division shall identify a vehicle category based on the VIN.
(3) If the vehicle does not have a VIN, or if the division is unable to determine the vehicle category based on the VIN:

     (3)(a) the owner shall provide the division with a description of the vehicle, including the vehicle’s purpose; and
     (3)(b) if the description of the vehicle fits with an existing category of vehicle, the vehicle shall be registered in accordance with that vehicle category.
(4) The vehicle shall be registered as a novel vehicle if:

     (4)(a) the vehicle is not expressly exempt from registration; and
     (4)(b)

          (4)(b)(i) the vehicle does not fit within a vehicle category;
          (4)(b)(ii) the unique characteristics of the vehicle make it unclear whether the vehicle fits within a vehicle category; or
          (4)(b)(iii) a reasonable person would not consider the vehicle to be clearly included in an existing vehicle category.
(5) A person registering a novel vehicle shall pay:

     (5)(a) in accordance with Section 59-2-405, an annual $1 fee in lieu of property tax; and
     (5)(b) an annual $1 registration fee, to be deposited into the Transportation Fund.
(6) The division shall issue a registration sticker or license plate for a vehicle that is registered as a novel vehicle, as appropriate.
(7) A vehicle registered as a street-legal novel vehicle is subject to the requirements described in Section 41-6a-1509.
(8) The division may provide title to a novel vehicle.
(9) Except as expressly provided in this chapter:

     (9)(a) a novel vehicle that is not a watercraft is subject to the provisions applicable to an off-highway vehicle under Chapter 22, Off-Highway Vehicles; and
     (9)(b) a novel vehicle that is a watercraft is subject to the provisions applicable to a motorboat under Title 73, Chapter 18, State Boating Act.
