Terms Used In Utah Code 53-2d-103

  • Ambulance: means a ground, air, or water vehicle that:
         (2)(a) transports patients and is used to provide emergency medical services; and
         (2)(b) is required to obtain a permit under Section 53-2d-404 to operate in the state. See Utah Code 53-2d-101
  • Bureau: means the Bureau of Emergency Medical Services created in Section 53-2d-102. See Utah Code 53-2d-101
  • Committee: means the Trauma System and Emergency Medical Services Committee created by Section 53-2d-104. See Utah Code 53-2d-101
  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 53-1-102
  • Emergency medical service personnel: includes a paramedic, medical director of a licensed emergency medical service provider, emergency medical service instructor, behavioral emergency services technician, other categories established by the committee, and a certified emergency medical dispatcher. See Utah Code 53-2d-101
  • Emergency medical service providers: means :
         (14)(a) licensed ambulance providers and paramedic providers;
         (14)(b) a facility or provider that is required to be designated under Subsection 53-2d-403(1)(a); and
         (14)(c) emergency medical service personnel. See Utah Code 53-2d-101
  • Emergency medical services: means :
         (15)(a) medical services;
         (15)(b) transportation services;
         (15)(c) behavioral emergency services; or
         (15)(d) any combination of the services described in Subsections (15)(a) through (c). See Utah Code 53-2d-101
  • Nonemergency secured behavioral health transport: means an entity that:
         (22)(a) provides nonemergency secure transportation services for an individual who:
              (22)(a)(i) is not required to be transported by an ambulance under Section 53-2d-405; and
              (22)(a)(ii) requires behavioral health observation during transport between any of the following facilities:
                   (22)(a)(ii)(A) a licensed acute care hospital;
                   (22)(a)(ii)(B) an emergency patient receiving facility;
                   (22)(a)(ii)(C) a licensed mental health facility; and
                   (22)(a)(ii)(D) the office of a licensed health care provider; and
         (22)(b) is required to be designated under Section 53-2d-403. See Utah Code 53-2d-101
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Utah Code 53-1-102
     (1)(a) coordinate the emergency medical services within the state;
     (1)(b) administer any programs and applicable rules created under this chapter;
     (1)(c) establish a voluntary task force representing a diversity of emergency medical service providers to advise the bureau and the committee on rules;
     (1)(d) establish an emergency medical service personnel peer review board to advise the bureau concerning discipline of emergency medical service personnel under this chapter; and
     (1)(e) adopt rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:

          (1)(e)(i) license ambulance providers and paramedic providers;
          (1)(e)(ii) permit ambulances, emergency medical response vehicles, and nonemergency secured behavioral health transport vehicles, including approving an emergency vehicle operator’s course in accordance with Section 53-2d-404;
          (1)(e)(iii) establish:

               (1)(e)(iii)(A) the qualifications for membership of the peer review board created by this section;
               (1)(e)(iii)(B) a process for placing restrictions on a license while an investigation is pending;
               (1)(e)(iii)(C) the process for the investigation and recommendation by the peer review board; and
               (1)(e)(iii)(D) the process for determining the status of a license while a peer review board investigation is pending;
          (1)(e)(iv) establish application, submission, and procedural requirements for licenses, designations, and permits; and
          (1)(e)(v) establish and implement the programs, plans, and responsibilities as specified in other sections of this chapter.

     (2)(a) The bureau shall share data related to the bureau’s duties with the Department of Health and Human Services.
     (2)(b) The Department of Health and Human Services shall share data related to the bureau’s duties with the bureau.
     (2)(c) All data collected by the bureau under this chapter is subject to Title 26B, Chapter 8, Part 4, Health Statistics, including data privacy protections.
