(1) A person who holds or is required to hold a CDL may not drive a commercial motor vehicle in this state if the person:
Terms Used In Utah Code 53-3-418
- Alcohol: means any substance containing any form of alcohol, including ethanol, methanol, propanol, and isopropanol. See Utah Code 53-3-402
- Alcohol concentration: means the number of grams of alcohol per:(2)(a) 100 milliliters of blood;(2)(b) 210 liters of breath; or(2)(c) 67 milliliters of urine. See Utah Code 53-3-402
- Arrest: Taking physical custody of a person by lawful authority.
- CDL: means a license:
(5)(a) issued substantially in accordance with the requirements of Title XII, Pub. See Utah Code 53-3-102- Commercial motor vehicle: means a motor vehicle or combination of motor vehicles designed or used to transport passengers or property if the motor vehicle:
(7)(a)(i) has a gross vehicle weight rating or gross vehicle weight of 26,001 or more pounds, or gross combination weight rating or gross combination weight of 26,001 or more pounds or a lesser rating as determined by federal regulation;(7)(a)(ii) is designed to transport 16 or more passengers, including the driver; or(7)(a)(iii) is transporting hazardous materials and is required to be placarded in accordance with Utah Code 53-3-102- Disqualification: means either:
(11)(a) the suspension, revocation, cancellation, denial, or any other withdrawal by a state of a person's privileges to drive a commercial motor vehicle;(11)(b) a determination by the Federal Highway Administration, under Utah Code 53-3-102- Division: means the Driver License Division of the department created in Section
53-3-103 . See Utah Code 53-3-102- Drive: means :
(14)(a) to operate or be in physical control of a motor vehicle upon a highway; and(14)(b) in Subsections53-3-414 (1) through (3), Subsection53-3-414 (5), and Sections53-3-417 and53-3-418 , the operation or physical control of a motor vehicle at any place within the state. See Utah Code 53-3-102- driver: includes any person who is required to hold a CDL under Part 4, Uniform Commercial Driver License Act, or federal law. See Utah Code 53-3-102
- Motor vehicle: means the same as that term is defined in Section
41-1a-102 . See Utah Code 53-3-102- Out-of-service order: means a temporary prohibition against driving a commercial motor vehicle. See Utah Code 53-3-402
- Peace officer: means any officer certified in accordance with Title 53, Chapter 13, Peace Officer Classifications. See Utah Code 53-1-102
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- State: means a state of the United States, the District of Columbia, any province or territory of Canada, or Mexico. See Utah Code 53-3-402
- Vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Utah Code 53-1-102
(1)(a) has sufficient alcohol in the person’s body that a subsequent chemical test shows that the person has a blood or breath alcohol concentration of .04 grams or greater at the time of the test after the alleged driving of the commercial motor vehicle;(1)(b) is under the influence of alcohol, any drug, or the combined influence of alcohol and any drug to degree that renders the person incapable of safely driving a commercial motor vehicle; or(1)(c) has a blood or breath alcohol concentration of .04 grams or greater at the time of driving the commercial motor vehicle.(2) A person who holds or is required to hold a CDL and who drives a commercial motor vehicle in this state is considered to have given the person’s consent to a test or tests of the person’s blood, breath, or urine to determine the concentration of alcohol or the presence of other drugs in the person’s physical system.(3) If a peace officer or port-of-entry agent has reasonable cause to believe that a person may be violating this section, the peace officer or port-of-entry agent may request the person to submit to a chemical test to be administered in compliance with Section 41-6a-515.(4) When a peace officer or port-of-entry agent requests a person to submit to a test under this section, the peace officer or port-of-entry agent shall advise the person that test results indicating a violation of Subsection (1) or refusal to submit to any test requested will result in the person’s disqualification under Section 53-3-414 from driving a commercial motor vehicle.(5) If test results under this section indicate a violation of Subsection (1) or the person refuses to submit to any test requested under this section, a peace officer or port-of-entry agent shall, on behalf of the division and within 24 hours of the arrest, give the person notice of the division’s intention to disqualify the person’s privilege to drive a commercial motor vehicle.(6) When a peace officer or port-of-entry agent gives notice under Subsection (5), the peace officer or port-of-entry agent shall:(6)(a) provide the driver, in a manner specified by the division, basic information regarding how to obtain a prompt hearing before the division; and(6)(b) issue a 24-hour out-of-service order.(7) As a matter of procedure, a peace officer or port-of-entry agent shall, within 10 calendar days after the day on which notice is provided, send to the division a copy of the notice, and a report signed by the peace officer or port-of-entry agent that indicates the results of any chemical test administered or that the person refused a test.(8)(8)(a) A person disqualified under this section has the right to a hearing regarding the disqualification.(8)(b) The request for the hearing shall be submitted to the division in a manner specified by the division and shall be made within 10 calendar days of the date the notice was issued. If requested, the hearing shall be conducted within 29 days after the date of arrest.(9)(9)(a)(9)(a)(i) Except as provided in Subsection (9)(a)(ii), a hearing held under this section shall be held before the division and in:(9)(a)(i)(A) the county where the notice was issued; or(9)(a)(i)(B) a county that is adjacent to the county where the notice was issued.(9)(a)(ii) The division may hold a hearing in some other county if the division and the person both agree.(9)(b) The hearing shall be documented and shall determine:(9)(b)(i) whether the peace officer or port-of-entry agent had reasonable grounds to believe the person had been driving a motor vehicle in violation of this section;(9)(b)(ii) whether the person refused to submit to any requested test; and(9)(b)(iii) any test results obtained.(9)(c) In connection with a hearing the division or its authorized agent may administer oaths and may issue subpoenas for the attendance of witnesses and the production of relevant books and documents.(9)(d) One or more members of the division may conduct the hearing.(9)(e) A decision made after a hearing before any number of members of the division is as valid as if the hearing were held before the full membership of the division.(9)(f) After a hearing under this section the division shall indicate by order if the person’s CDL is disqualified.(9)(g) If the person for whom the hearing is held fails to appear before the division as required in the notice, the division shall indicate by order if the person’s CDL is disqualified.(10)(10)(a) If the division disqualifies a person under this section following an administrative hearing, the person may petition for a hearing under Section 53-3-224.(10)(b) The petition shall be filed within 30 days after the division issues the disqualification.(11)(11)(a) A person who violates this section shall be punished in accordance with Section 53-3-414.(12)(13) Notwithstanding the provisions of this section, a blood test taken under this section is subject to Section 77-23-213.
