Utah Code 53G-9-305. Regulations of department

(1) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department shall make rules regarding:

Department: means the Department of Health and Human Services created in Section 26B-1-201. See Utah Code 53G-9-301
School: means any public or private:
          (10)(a)(i) elementary or secondary school through grade 12;
          (10)(a)(ii) preschool;
          (10)(a)(iii) child care program, as that term is defined in Section 26B-2-401;
          (10)(a)(iv) nursery school; or
          (10)(a)(v) kindergarten. See Utah Code 53G-9-301
vaccination: means the administration of a vaccine. See Utah Code 53G-9-301

(1)(a) which vaccines are required as a condition of attending school;

(1)(b) the manner and frequency of the vaccinations; and

(1)(c) the vaccination exemption form described in Section 53G-9-304.

(2) The department shall ensure that the rules described in Subsection (1):

(2)(a) conform to recognized standard medical practices; and

(2)(b) require schools to report to the department statistical information and names of students who are not in compliance with Section 53G-9-302.
