Terms Used In Utah Code 58-11a-306

  • Approved esthetician apprenticeship: means an apprenticeship that meets the requirements of Subsection 58-11a-306(4) and the requirements established by rule by the division in collaboration with the board in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. See Utah Code 58-11a-102
  • Approved eyelash and eyebrow technician apprenticeship: means an apprenticeship that meets the requirements of Subsection 58-11a-306(7) and the requirements established by rule by the division in collaboration with the board in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.   • Approved nail technician apprenticeship: means an apprenticeship that meets the requirements of Subsection 58-11a-306(6) and the requirements established by rule by the division in collaboration with the board in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.   • Barber: means a person who is licensed under this chapter to engage in the practice of barbering. See Utah Code 58-11a-102
  • Barber instructor: means a barber who is licensed under this chapter to engage in the practice of barbering instruction. See Utah Code 58-11a-102
  • Department: means the Department of Commerce. See Utah Code 58-1-102
  • Direct supervision: means that the supervisor of an apprentice or the instructor of a student is physically present in the same building as the apprentice or student and readily able to establish direct contact with the apprentice or student for consultation, advice, instruction, and evaluation. See Utah Code 58-11a-102
  • Division: means the Division of Professional Licensing created in Section 58-1-103. See Utah Code 58-1-102
  • Esthetician: means a person who is licensed under this chapter to engage in the practice of esthetics. See Utah Code 58-11a-102
  • Esthetician instructor: means a master esthetician who is licensed under this chapter to engage in the practice of esthetics instruction. See Utah Code 58-11a-102
  • Eyelash and eyebrow technician: means a person who is licensed under this chapter to engage in the practice of eyelash and eyebrow technology. See Utah Code 58-11a-102
  • Eyelash and eyebrow technician instructor: means an eyelash and eyebrow technician licensed under this chapter to engage in the practice of eyelash and eyebrow technology instruction. See Utah Code 58-11a-102
  • Hair designer: means a person who is licensed under this chapter to engage in the practice of hair design. See Utah Code 58-11a-102
  • Hair designer instructor: means a hair designer who is licensed under this chapter to engage in the practice of hair design instruction. See Utah Code 58-11a-102
  • Master esthetician: means an individual who is licensed under this chapter to engage in the practice of master-level esthetics. See Utah Code 58-11a-102
  • Nail technician: means an individual who is licensed under this chapter to engage in the practice of nail technology. See Utah Code 58-11a-102
  • Nail technician instructor: means a nail technician licensed under this chapter to engage in the practice of nail technology instruction. See Utah Code 58-11a-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
     (1)(a) consist of not less than 1,250 hours of training; and
     (1)(b) be conducted by a supervisor who:

          (1)(b)(i) is licensed under this chapter as a barber instructor or a cosmetology/barber instructor; and
          (1)(b)(ii) provides one-on-one direct supervision of the barber apprentice during the apprenticeship program.
(2) An approved cosmetologist/barber apprenticeship shall:

     (2)(a) consist of not less than 2,500 hours of training; and
     (2)(b) be conducted by a supervisor who:

          (2)(b)(i) is licensed under this chapter as a cosmetologist/barber instructor; and
          (2)(b)(ii) provides one-on-one direct supervision of the cosmetologist/barber apprentice during the apprenticeship program.
(3) An approved hair designer apprenticeship shall:

     (3)(a) consist of not less than 1,600 hours of training; and
     (3)(b) be conducted by a supervisor who:

          (3)(b)(i) is licensed under this chapter as a hair designer instructor or a cosmetologist/barber instructor; and
          (3)(b)(ii) provides one-on-one direct supervision of the hair designer apprentice during the apprenticeship program.
(4) An approved esthetician apprenticeship shall:

     (4)(a) consist of not less than 800 hours of training; and
     (4)(b) be conducted by a supervisor who:

          (4)(b)(i) is licensed under this chapter as an esthetician instructor; and
          (4)(b)(ii) provides one-on-one direct supervision of the esthetician apprentice during the apprenticeship program.
(5) An approved master esthetician apprenticeship shall:

     (5)(a) consist of not less than 1,500 hours of training; and
     (5)(b) be conducted by a supervisor who:

          (5)(b)(i) is licensed under this chapter as a master-level esthetician instructor; and
          (5)(b)(ii) provides one-on-one direct supervision of the master esthetician apprentice during the apprenticeship program.
(6) An approved nail technician apprenticeship shall:

     (6)(a) consist of not less than 375 hours of training; and
     (6)(b) be conducted by a supervisor who:

          (6)(b)(i) is licensed under this chapter as a nail technician instructor or a cosmetology/barber instructor;
          (6)(b)(ii) provides direct supervision of the nail technician apprentice during the apprenticeship program; and
          (6)(b)(iii) provides direct supervision to no more than two nail technician apprentices during the apprentice program.
(7) An approved eyelash and eyebrow technician apprenticeship shall:

     (7)(a) consist of not less than 125 hours of training; and
     (7)(b) be conducted by a supervisor who:

          (7)(b)(i) is licensed under this chapter as an eyelash and eyebrow technician instructor or a cosmetology/barber instructor;
          (7)(b)(ii) provides direct supervision of the eyelash and eyebrow technician apprentice during the apprenticeship program; and
          (7)(b)(iii) provides direct supervision to no more than two eyelash and eyebrow technician apprentices during the apprenticeship program.
(8) A person seeking to qualify for licensure by apprenticing in an approved apprenticeship under this chapter shall:

     (8)(a) register with the division before beginning the training requirements by:

          (8)(a)(i) submitting a form prescribed by the division, which includes the name of the licensed supervisor; and
          (8)(a)(ii) paying a fee determined by the department under Section 63J-1-504;
     (8)(b) complete the apprenticeship within five years of the date on which the division approves the registration; and
     (8)(c) notify the division within 30 days if the licensed supervisor changes after the registration is approved by the division.
(9) Notwithstanding Subsection (8), if a person seeking to qualify for licensure by apprenticing in an approved apprenticeship under this chapter registers with the division before January 1, 2017, any training requirements completed by the person as an apprentice in an approved apprenticeship before registration may be applied to successful completion of the approved apprenticeship.
