(1) A physician may not represent to another person that the physician is certified in a medical specialty or certified by a particular board unless:

- Board: means the Physicians Licensing Board created in Section
58-67-201 . See Utah Code 58-67-102 - Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Physician: means both physicians and surgeons licensed under Section
58-67-301 , Utah Medical Practice Act, and osteopathic physicians and surgeons licensed under Section58-68-301 , Utah Osteopathic Medical Practice Act. See Utah Code 58-67-102(1)(a) the physician includes in the representation the name of:(1)(a)(i) the certification board or entity; and(1)(a)(ii) the medical specialty for which the physician is certified; and(1)(b) the board or certification entity meets the requirements of Subsection(2) . - Physician: means both physicians and surgeons licensed under Section
(2) A certification entity or board under Subsection (1) shall meet the following qualifications:
(2)(a) be included in the American Board of Medical Specialties or an American Osteopathic Association Certifying Board; or
(2)(b)
(2)(b)(i) require an Accreditation Council for Graduate Medical Education or American Osteopathic Association approved postgraduate training program that provides complete training in the specialty or subspeciality; and
(2)(b)(ii) be certified or had prior certification by the member board of the American Board of Medical Specialties or an American Osteopathic Certifying Board.
