(1) A procurement unit may allow a vendor to correct an immaterial error in a responsive solicitation response as provided in this section.
Terms Used In Utah Code 63G-6a-114
- Procurement: means the acquisition of a procurement item through an expenditure of public funds, or an agreement to expend public funds, including an acquisition through a public-private partnership. See Utah Code 63G-6a-103
- Responsive: means conforming in all material respects to the requirements of a solicitation. See Utah Code 63G-6a-103
- Solicitation: means an invitation for bids, request for proposals, or request for statement of qualifications. See Utah Code 63G-6a-103
- Solicitation response: means :(84)(a) a bid submitted in response to an invitation for bids;(84)(b) a proposal submitted in response to a request for proposals; or(84)(c) a statement of qualifications submitted in response to a request for statement of qualifications. See Utah Code 63G-6a-103
- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5(2)(2)(a) A procurement unit that allows a vendor to correct an immaterial error in a responsive solicitation response shall:(2)(a)(i) require the vendor to submit the correction in writing; and(2)(a)(ii) establish a deadline by which the vendor is required to correct the immaterial error.(2)(b) A procurement unit may not allow a vendor to correct an immaterial error in a responsive solicitation response after the deadline established under Subsection (2)(a). - Writing: includes :
