(1) A procurement unit that intends to award a contract for a procurement item using the bidding process shall issue an invitation for bids.

Terms Used In Utah Code 63G-6a-603

  • Bidding process: means the procurement process described in Part 6, Bidding. See Utah Code 63G-6a-103
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract: means an agreement for a procurement. See Utah Code 63G-6a-103
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Procurement: means the acquisition of a procurement item through an expenditure of public funds, or an agreement to expend public funds, including an acquisition through a public-private partnership. See Utah Code 63G-6a-103
  • Procurement item: means an item of personal property, a technology, a service, or a construction project. See Utah Code 63G-6a-103
(2) A procurement unit shall include in an invitation for bids:

     (2)(a) a description of the procurement item that the procurement unit seeks;
     (2)(b) instructions for submitting a bid, including the deadline for submitting a bid;
     (2)(c) the objective criteria that the procurement unit will use to evaluate bids;
     (2)(d) information about the time and manner of opening bids; and
     (2)(e) terms and conditions that the procurement unit intends to include in a contract resulting from the bidding process.
(3) A procurement unit shall publish an invitation for bids in accordance with the requirements of Section 63G-6a-112.
