(1) The division shall cancel, in whole or in part:
Terms Used In Utah Code 70-3a-307
- Division: means the Division of Corporations and Commercial Code within the Department of Commerce. See Utah Code 70-3a-103
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Mark: means any trademark or service mark entitled to registration under this chapter whether or not the trademark or service mark is registered. See Utah Code 70-3a-103
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Registrant: means :
(1)(f)(i) the person to whom the registration of a mark under this chapter is issued; and(1)(f)(ii) a legal representative, successor, or assign of a person described in Subsection(1)(f)(i) . See Utah Code 70-3a-103- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- trademark: means :
(1)(h)(i)(A) a word, term, name, symbol, design, or device; or(1)(h)(i)(B) any combination of words, terms, names, symbols, designs, or devices. See Utah Code 70-3a-103- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
(1)(a) a registration of mark for which the division receives a voluntary request for the registration’s cancellation from:(1)(a)(i) the registrant; or(1)(a)(ii) the assignee of record;(1)(b) a registration of a mark:(1)(b)(i) granted under this chapter; and(1)(b)(ii) not renewed in accordance with the chapter;(1)(c) a registration of a mark for which a court of competent jurisdiction finds that:(1)(c)(i) the registered mark has been abandoned;(1)(c)(ii) the registrant is not the owner of the mark;(1)(c)(iii) the registration was granted improperly;(1)(c)(iv) the registration was obtained fraudulently;(1)(c)(v) the mark is or has become the generic name for the goods or services, or a portion of the goods or services, for which the mark has been registered; or(1)(c)(vi) subject to Subsection(2) , the mark is so similar, as to be likely to cause confusion, mistake, or to deceive, to a mark:(1)(c)(vi)(A) registered by another person in the United States Patent and Trademark Office prior to the date of the filing of the application for registration by the registrant; and(1)(c)(vi)(B) not abandoned; or(1)(d) when a court of competent jurisdiction orders cancellation of a registration on any ground.(2) Notwithstanding Subsection(1)(c)(vi) , if the registrant proves the registrant is the owner of a concurrent registration of a mark in the United States Patent and Trademark Office covering an area including this state, the registration under this chapter may not be cancelled for that particular area of the state. - Registrant: means :
