(1) The department may conduct investigations, inquiries, and hearings concerning matters covered by this chapter and accidents or injuries incident to the operation of aircraft occurring within this state.
Terms Used In Utah Code 72-10-104
- Aircraft: means any contrivance now known or in the future invented, used, or designed for navigation of or flight in the air. See Utah Code 72-10-102
- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 72-1-102
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Person: means any individual, corporation, limited liability company, or association of individuals. See Utah Code 72-10-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Subpoena: A command to a witness to appear and give testimony.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
(2) The department may:
(2)(a) administer oaths and affirmations;
(2)(b) certify to all official acts;
(2)(c) issue subpoenas;
(2)(d) compel the attendance and testimony of witnesses; and
(2)(e) compel the production of papers, books, and documents.

(3)(a) If any person fails to comply with any subpoena or order issued by the department, the department may petition any district court in this state to order compliance.
(3)(b) The district court may order the person to comply with the requirements of the subpoena or order of the department, or to give evidence upon the matter in question.
(3)(c) Any failure to obey the order of the court may be punished by the court as contempt.
