Terms Used In Utah Code 72-10-117
- Aircraft: means any contrivance now known or in the future invented, used, or designed for navigation of or flight in the air. See Utah Code 72-10-102
- Construction: means the construction, reconstruction, replacement, and improvement of the highways, including the acquisition of rights-of-way and material sites. See Utah Code 72-1-102
- Contract: A legal written agreement that becomes binding when signed.
- County executive: means :(7)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(7)(b) the county executive, in the county executive-council optional form of government authorized by Section
17-52a-203 ; or(7)(c) the county manager, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 72-1-102
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Pilot: means any person who operates the controls of an aircraft while in-flight. See Utah Code 72-10-102
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Road: includes :
(33)(a) a public bridge;(33)(b) a county way;(33)(c) a county road;(33)(d) a common road; and(33)(e) a state road. See Utah Code 68-3-12.5(1)(a) The county executive of any county may issue a permit authorizing an aircraft to land on or take off from designated county roads.(1)(b) The county executive of any county may issue a permit to an aircraft operated:(1)(b)(i) as an air ambulance;(1)(b)(ii) as a pesticide applicator; or(1)(b)(iii) by or under contract with a public utility and used in connection with inspection, maintenance, installation, operation, construction, or repair of property owned or operated by the public utility.(2) The county executive of any county may issue a permit under this section to other aircraft under rules made by the department.(3)(3)(a) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department shall make rules for issuing a special license to:(3)(a)(i) an aircraft permitted by a county executive to land on a county road; and(3)(a)(ii) a pilot permitted to operate an aircraft licensed under this subsection from a county road.(3)(b) The rules made under this subsection shall include provisions for the safety of the flying and motoring public.(4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department shall make rules for the landing and taking off of aircraft to which permits have been issued under this section, which may include annual reports of activities of the aircraft.(5) Before obtaining a permit or license under this section, the applicant shall file with the county executive and the department proof of public liability insurance coverage that meets the requirements described in Section 31A-22-1300.(6) In addition to the insurance required under this section, either the county executive or the department may require the posting of a bond to indemnify the county or department against liability resulting from issuing the permit or license under this section.
