(1) No bond is required of a personal representative appointed in formal or informal proceedings, except:
Terms Used In Utah Code 75-3-603
- Court: means any of the courts of record in this state having jurisdiction in matters relating to the affairs of decedents. See Utah Code 75-1-201 v2
- Estate: includes the property of the decedent, trust, or other person whose affairs are subject to this title as originally constituted and as it exists from time to time during administration. See Utah Code 75-1-201 v2
- Personal representative: includes executor, administrator, successor personal representative, special administrator, and persons who perform substantially the same function under the law governing their status. See Utah Code 75-1-201 v2
- Special administrator: means a personal representative as described in Sections
75-3-614 through75-3-618 . See Utah Code 75-1-201 v2
(1)(a) upon the appointment of a special administrator without notice having been given;
(1)(b) when an executor or other personal representative is appointed to administer an estate under a will containing an express requirement of bond;
(1)(c) when bond is requested prior to appointment, by an interested party; or
(1)(d) when bond is required under Section 75-3-605. No bond is required of any personal representative who is exempted from bond under Title 7, Financial Institutions Act.
(2) A bond required pursuant to this section may be dispensed with upon a determination by the court that it is not necessary.
