(1) As used in this section, “vulnerable adult” means:

Terms Used In Utah Code 78B-6-115

  • Adoptee: means a person who:
         (1)(a) is the subject of an adoption proceeding; or
         (1)(b) has been legally adopted. See Utah Code 78B-6-103
  • Adoption: means the judicial act that:
         (2)(a) creates the relationship of parent and child where it did not previously exist; and
         (2)(b) except as provided in Subsections 78B-6-138(2) and (4), terminates the parental rights of any other person with respect to the child. See Utah Code 78B-6-103
  • Adoption proceeding: means any proceeding under this part. See Utah Code 78B-6-103
  • Adoptive parent: means an individual who has legally adopted an adoptee. See Utah Code 78B-6-103
  • Adult: means an individual who is 18 years old or older. See Utah Code 78B-6-103
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Mature adoptee: means an adoptee who is adopted when the adoptee is an adult. See Utah Code 78B-6-103
     (1)(a) an individual who is 65 years old or older; or
     (1)(b) an adult who is 18 years old or older, and who has a mental or physical impairment that substantially affects that adult’s ability to:

          (1)(b)(i) provide personal protection;
          (1)(b)(ii) provide necessities such as food, shelter, clothing, or medical or other health care;
          (1)(b)(iii) obtain services necessary for health, safety, or welfare;
          (1)(b)(iv) carry out the activities of daily living;
          (1)(b)(v) manage the adult’s own resources; or
          (1)(b)(vi) comprehend the nature and consequences of remaining in a situation of abuse, neglect, or exploitation.
(2) Subject to this section and Section 78B-6-117, any adult may be adopted by another adult.
(3) The following provisions of this part apply to the adoption of an adult just as though the individual being adopted were a minor:

          (3)(a)(ii) Section 78B-6-114;
          (3)(a)(iii) Section 78B-6-116;
          (3)(a)(iv) Section 78B-6-118;
          (3)(a)(v) Section 78B-6-124;
          (3)(a)(vi) Section 78B-6-136;
          (3)(a)(vii) Section 78B-6-137;
          (3)(a)(viii) Section 78B-6-138;
          (3)(a)(ix) Section 78B-6-139;
          (3)(a)(x) Section 78B-6-141; and
          (3)(a)(xi) Section 78B-6-142;
     (3)(b) Subsections 78B-6-105(1)(a), (1)(b)(i), (1)(b)(ii), (2), and (7), except that the juvenile court does not have jurisdiction over a proceeding for adoption of an adult, unless the adoption arises from a case where the juvenile court has continuing jurisdiction over the mature adoptee; and
     (3)(c) if the mature adoptee is a vulnerable adult, Sections 78B-6-128 through 78B-6-131, regardless of whether the mature adoptee resides, or will reside, with the adopters, unless the court, based on a finding of good cause, waives the requirements of those sections.
(4) Before a court enters a final decree of adoption of a mature adoptee, the mature adoptee and the prospective adoptive parent or parents shall appear before the court presiding over the adoption proceeding and execute consent to the adoption.
(5) No provision of this part, other than those listed or described in this section or Section 78B-6-117, apply to the adoption of an adult.
