The plaintiff may not recover costs of the action if:
(1) the defendant disclaims in his answer any interest or estate in the property; or

- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Property: includes both real and personal property. See Utah Code 68-3-12.5
(2) allows judgment to be taken against him by refusing to answer.
