Terms Used In Utah Code 80-4-204
- Child: means , except as provided in Section
80-2-905 , an individual who is under 18 years old. See Utah Code 80-1-102 - Legal custody: means a relationship embodying:(50)(a) the right to physical custody of the minor;(50)(b) the right and duty to protect, train, and discipline the minor;(50)(c) the duty to provide the minor with food, clothing, shelter, education, and ordinary medical care;(50)(d) the right to determine where and with whom the minor shall live; and(50)(e) the right, in an emergency, to authorize surgery or other extraordinary care. See Utah Code 80-1-102
- Termination of parental rights: means the permanent elimination of all parental rights and duties, including residual parental rights and duties, by court order. See Utah Code 80-1-102
(1)(a) After a petition for termination of parental rights is filed, notice shall:(1)(a)(i) be provided to the parents, the guardian, the individual or agency having legal custody of the child, and any individual acting in loco parentis to the child; and(1)(a)(ii) indicate the:(1)(a)(ii)(A) nature of the petition;(1)(a)(ii)(B) time and place of the hearing;(1)(a)(ii)(C) right to counsel; and(1)(a)(ii)(D) right to the appointment of counsel for a party whom the juvenile court determines is indigent and at risk of losing the party’s parental rights.(1)(b) The notice described in Subsection (1)(a), or a separate notice subsequently issued, shall contain a statement to the effect that the rights of the parent or parents are proposed to be permanently terminated in the proceedings.
(2) The juvenile court shall hold a hearing specifically on the question of termination of parental rights no sooner than 10 days after the day on which the notice described in Subsection (1) is served.
