Terms Used In Rhode Island General Laws > Chapter 4-11 - Psittacine Birds
- Adjudicated parent: means an individual who has been adjudicated by a court of competent jurisdiction to be a parent of a child. See Rhode Island General Laws 15-8.1-102
- Advertise: means all representations disseminated in any manner or by any means, other than by labeling, for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of frozen desserts and/or frozen dessert mixes. See Rhode Island General Laws 21-9-1
- Alleged genetic parent: means an individual who is alleged to be, or alleges that the individual is, a genetic parent or possible genetic parent of a child whose parentage has not been adjudicated. See Rhode Island General Laws 15-8.1-102
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Assisted reproduction: means a method of causing pregnancy other than through sexual intercourse and includes, but is not limited to:
(i) Intrauterine, intracervical, or vaginal insemination;
(ii) Donation of gametes;
(iii) Donation of embryos;
(iv) In vitro fertilization and transfer of embryos; and
(v) Intracytoplasmic sperm injection. See Rhode Island General Laws 15-8.1-102
- Birth: includes stillbirth and fetal death. See Rhode Island General Laws 15-8.1-102
- Child: means an individual of any age whose parentage may be determined pursuant to this chapter. See Rhode Island General Laws 15-8.1-102
- Commission: means the Rhode Island milk commission. See Rhode Island General Laws 21-4.1-2
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Dealer: means any person who purchases or receives milk from a producer for the purpose of resale. See Rhode Island General Laws 21-4.1-2
- Department: means the department of health. See Rhode Island General Laws 21-4.1-2
- Determination of parentage: means establishment of a parent-child relationship by a judicial or administrative proceeding or signing of a valid acknowledgement of parentage pursuant to article 3 of this chapter. See Rhode Island General Laws 15-8.1-102
- Director: means the director of health. See Rhode Island General Laws 21-1-2
- Director: means the director of health or his or her duly authorized agents. See Rhode Island General Laws 21-4.1-2
- Director of health: means the director of health of Rhode Island. See Rhode Island General Laws 21-9-1
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fraud: Intentional deception resulting in injury to another.
- Frozen dessert mix: means any unfrozen mixture that can be used in the manufacture of frozen desserts or freezer milk shakes and substitutes or imitations of them offered for sale or resale. See Rhode Island General Laws 21-9-1
- Frozen dessert plant: means any building, establishment, place, or premises or any part of it where frozen desserts and/or frozen dessert mixes are manufactured into a form for distribution, and any building, establishment, place, or premises or any part of it where equipment for the manufacture of frozen desserts and/or frozen dessert mixes is washed, sterilized, kept, or maintained. See Rhode Island General Laws 21-9-1
- Frozen food: means and includes any article used for food or drink for man or other animals which has been: (i) processed, (ii) preserved, and/or (iii) packaged, and (iv) is destined for sale in a frozen state. See Rhode Island General Laws 21-1-2
- Gestational carrier: means an adult individual who is not an intended parent and who enters into a gestational carrier agreement to bear a child conceived using the gametes of another individual and not the gestational carrier's own, except that an individual who carries a child for a family member using the gestational carrier's own gametes and who fulfills the requirements of article 8 of this chapter is a gestational carrier. See Rhode Island General Laws 15-8.1-102
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Intended parent: means an individual, whether married or unmarried, who manifests an intent to be legally bound as a parent of a child conceived through assisted reproduction or a gestational carrier agreement. See Rhode Island General Laws 15-8.1-102
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- justice of the peace: include warden of the peace and the words "district court" include warden's court. See Rhode Island General Laws 43-3-14
- Labeling: means all labels and other written, printed, or graphic matter: (i) upon a frozen dessert and/or frozen dessert mix or any of its container or wrappers, or (ii) accompanying such products. See Rhode Island General Laws 21-9-1
- magistrate: may be construed to mean a justice, or a clerk acting as a justice, of a district court. See Rhode Island General Laws 43-3-16
- Manufacture: means assemble, process, prepare, produce, and/or convert. See Rhode Island General Laws 21-9-1
- Marriage: means and includes civil union and any legal relationship that provides substantially the same rights, benefits, and responsibilities as marriage and is recognized as valid in the state or jurisdiction in which it was entered. See Rhode Island General Laws 15-8.1-102
- Misleading: means that if an article is alleged to be misbranded because the labeling is misleading, or if an advertisement is alleged to be false because it is misleading, then in determining whether the labeling or advertisement is misleading, there shall be taken into account (among other things) not only representations made or suggested by statement, work, design, device, sound, or in any combination of them, but also the extent to which the labeling or advertisement fails to reveal facts material in the light of the representations or material with respect to consequences which may result from the use of the article to which the labeling or advertisement relates under the conditions of use prescribed in the labeling or advertisement thereof or under any conditions of use that are customary or usual. See Rhode Island General Laws 21-9-1
- Mobile unit: means any vehicle on which frozen desserts are manufactured and which is used for the sale of frozen desserts and/or freezer milk shakes to the consumer. See Rhode Island General Laws 21-9-1
- Parent: means an individual who has established parentage that meets the requirements of this chapter. See Rhode Island General Laws 15-8.1-102
- Parentage: means the legal relationship between a child and a parent as established under this chapter. See Rhode Island General Laws 15-8.1-102
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means any individual, partnership, firm, corporation, association or other unit, and the state and all political subdivisions or agencies of the state, except state owned and operated institutions. See Rhode Island General Laws 21-4.1-2
- Person: includes one or more individuals, a firm, partnership, corporation, or association. See Rhode Island General Laws 21-9-1
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- possession: means the exercise of dominion or control over cultured crops commencing at the time that a decision is made not to return the crops to the lease or facility from which they were taken. See Rhode Island General Laws 20-1-3
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Presumed parent: means a person who is presumed to be the parent of a child under Rhode Island General Laws 15-8.1-102
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Producer: means a Rhode Island dairy farmer who produces milk that is moved, other than in packaged form, from his or her farm to a pool plant or any other plant as diverted milk. See Rhode Island General Laws 21-4.1-2
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Sale: means any and every transaction including the barter, dispensing, distributing, delivering, serving, giving away, offer for sale, exposing, storing, or any other possession of frozen desserts and/or frozen dessert mixes by any person whether as principal, proprietor, agent, servant, or employee where the products are subject to transfer to another person. See Rhode Island General Laws 21-9-1
- Sign: means , with the intent to authenticate or adopt a record, to:
(i) Execute or adopt a tangible symbol; or
(ii) Attach to or logically associate with the record an electronic symbol, sound, or process. See Rhode Island General Laws 15-8.1-102
- Statute: A law passed by a legislature.
- Summons: Another word for subpoena used by the criminal justice system.
- town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trustee: A person or institution holding and administering property in trust.
- United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
- Wholesale manufacturer: means a person who manufactures frozen desserts and/or frozen dessert mixes for distribution to a second person for redistribution or for manufacturing purposes. See Rhode Island General Laws 21-9-1
- Witnessed: means that at least one individual is authorized to sign and has signed a record to verify that the individual personally observed a signatory sign the record. See Rhode Island General Laws 15-8.1-102
