- Administer: means the direct application of an epinephrine auto-injector to the body of an individual. See Rhode Island General Laws 23-6.4-1
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Agent: means a person empowered by the patient to assert or waive the confidentiality, or to disclose or consent to the disclosure of confidential information, as established by Rhode Island General Laws 23-6.3-2
- AIDS: means the medical condition known as acquired immune deficiency syndrome, caused by infection of an individual by the human immunodeficiency virus (HIV). See Rhode Island General Laws 23-6.3-2
- Antibody: means a protein produced by the body in response to specific foreign substances such as bacteria or viruses. See Rhode Island General Laws 23-6.3-2
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Approved public treatment facility: means a treatment agency operating under the direction and control of the department or providing treatment under this chapter through a contract with the department. See Rhode Island General Laws 23-10.1-2
- Arrest: Taking physical custody of a person by lawful authority.
- Authorized entity: means any entity or organization at, or in connection with, where allergens capable of causing anaphylaxis may be present, as identified by the department of health. See Rhode Island General Laws 23-6.4-1
- Authorized healthcare provider: means a physician, nurse, or other person duly authorized by law, in the state in which they practice, to prescribe drugs. See Rhode Island General Laws 23-6.4-1
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Consent: means an explicit exchange of information between a person and a healthcare provider or qualified professional HIV test counselor through which an informed individual can choose whether to undergo HIV testing or decline to do so. See Rhode Island General Laws 23-6.3-2
- Contract: A legal written agreement that becomes binding when signed.
- Controlled substance: means a drug, substance, or immediate precursor in schedules I-V listed in the provisions of chapter 28 of Title 21 entitled, "Uniform Controlled Substances Act. See Rhode Island General Laws 23-6.3-2
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Department: means the Rhode Island department of health. See Rhode Island General Laws 23-6.3-2
- Department: means the state department of behavioral healthcare, developmental disabilities and hospitals. See Rhode Island General Laws 23-10.1-2
- Director: means the director of the department of health, or any subordinate or subordinates to whom he or she has delegated the powers and duties vested in him or her by this chapter. See Rhode Island General Laws 23-7.1-3
- Director: means the director of the state department of behavioral healthcare, developmental disabilities and hospitals. See Rhode Island General Laws 23-10.1-2
- Director: means the director of the Rhode Island department of health. See Rhode Island General Laws 23-6.3-2
- Drug intoxication: means an altered physiological substance or psychoactive substances, in which normal functioning is seriously impeded. See Rhode Island General Laws 23-10.1-2
- ELISA result: means enzyme-linked immunosorbent assay or EIA (enzyme immunoassay) which is a serologic technique used in immunology to detect the presence of either antibody or antigen. See Rhode Island General Laws 23-6.3-2
- Epinephrine auto-injector: means a single-use device used for the automatic injection of a premeasured dose of epinephrine into the human body. See Rhode Island General Laws 23-6.4-1
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Fault: means wrongful act, omission, breach, or default. See Rhode Island General Laws 6A-2.1-103
- Federal government: means the government of the United States of America. See Rhode Island General Laws 23-7.1-3
- Finance lease: means a lease with respect to which:
(i) The lessor does not select, manufacture, or supply the goods;
(ii) The lessor acquires the goods or the right to possession and use of the goods in connection with the lease; and
(iii) One of the following occurs:
(A) The lessee receives a copy of the contract by which the lessor acquired the goods or the right to possession and use of the goods before signing the lease contract;
(B) The lessee's approval of the contract by which the lessor acquired the goods or the right to possession and use of the goods is a condition to effectiveness of the lease contract;
(C) The lessee, before signing the lease contract, receives an accurate and complete statement designating the promises and warranties, and any disclaimers of warranties, limitations or modifications of remedies, or liquidated damages, including those of a third party, such as the manufacturer of the goods, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods; or
(D) If the lease is not a consumer lease, the lessor, before the lessee signs the lease contract, informs the lessee in writing (a) of the identity of the person supplying the goods to the lessor, unless the lessee has selected that person and directed the lessor to acquire the goods or the right to possession and use of the goods from that person, (b) that the lessee is entitled under this chapter to the promises and warranties, including those of any third party, provided to the lessor by the person supplying the goods in connection with or as part of the contract by which the lessor acquired the goods or the right to possession and use of the goods, and (c) that the lessee may communicate with the person supplying the goods to the lessor and receive an accurate and complete statement of those promises and warranties, including any disclaimers and limitations of them or of remedies. - Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fraud: Intentional deception resulting in injury to another.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Health benefits: include accident and sickness, including disability or health insurance, health benefit plans and/or policies, hospital, health, or medical service plans, or any health maintenance organization plan pursuant to title 27 or otherwise. See Rhode Island General Laws 23-6.3-2
- Healthcare facility: means those facilities licensed by the department in accordance with the provisions of chapter 17 of this title. See Rhode Island General Laws 23-6.3-2
- Healthcare settings: means venues offering clinical STD services including, but not limited to, hospitals, urgent care clinics, STD clinics and other substance abuse treatment facilities, mental health treatment facilities, community health centers, primary care and OB/GYN physician offices, and family planning providers. See Rhode Island General Laws 23-6.3-2
- HIV: means the human immunodeficiency virus, the pathogenic organism responsible for HIV infection and/or the acquired immunodeficiency syndrome (AIDS) in humans. See Rhode Island General Laws 23-6.3-2
- HIV counseling: means an interactive process of communication between a person and a healthcare provider or qualified professional HIV test counselor during which there is an assessment of the person's risks for HIV infection and the provision of counseling to assist the person with behavior changes that can reduce risks for acquiring HIV infection. See Rhode Island General Laws 23-6.3-2
- HIV screening: means the conduct of HIV testing among those who do not show signs or symptoms of an HIV infection. See Rhode Island General Laws 23-6.3-2
- HIV test: means any currently medically accepted and/or FDA approved test for determining HIV infection in humans. See Rhode Island General Laws 23-6.3-2
- in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
- Joint resolution: A legislative measure which requires the approval of both chambers.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Rhode Island General Laws 6A-2.1-103
- Lessee: means a person who acquires the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Lessor: means a person who transfers the right to possession and use of goods under a lease. See Rhode Island General Laws 6A-2.1-103
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Lien: A claim against real or personal property in satisfaction of a debt.
- Likely to injure him or herself or others: means :
(i) A substantial risk of physical harm to himself or herself as manifested by behavior evidencing serious threats of, or attempts at, suicide or by behavior which will result in serious bodily harm; or
(ii) A substantial risk of physical harm to other persons as manifested by behavior or threats evidencing homicidal or other violent behavior. See Rhode Island General Laws 23-10.1-2
- Local communities: means any cities and towns of Rhode Island. See Rhode Island General Laws 23-7.1-3
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Occupational health representative: means a person, within a healthcare facility, trained to respond to occupational, particularly blood borne, exposures. See Rhode Island General Laws 23-6.3-2
- Opts out: means that a person who has been notified that a voluntary HIV test will be performed, has elected to decline or defer testing. See Rhode Island General Laws 23-6.3-2
- Oversight: Committee review of the activities of a Federal agency or program.
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means any individual, trust or estate, partnership, corporation (including associations, joint stock companies), limited liability companies, state, or political subdivision or instrumentality of a state. See Rhode Island General Laws 23-6.3-2
- Person: means any individual, firm, private corporation, association, partnership, municipal corporation, or any other entity recognized by the law as a subject of rights and duties. See Rhode Island General Laws 23-7.1-3
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- Personal property: All property that is not real property.
- Physician: means a person duly licensed to practice medicine or osteopathy in this state. See Rhode Island General Laws 23-10.1-2
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- public place: means an enclosed area capable of holding three hundred (300) people or more and to which the public is invited or in which the public is permitted, including, but not limited to: banks; bars; educational facilities; healthcare facilities; laundromats; public transportation facilities; reception areas; restaurants; retail food production and marketing establishments; retail service establishments; retail stores; shopping malls; sports arenas; government offices; theaters; and waiting rooms. See Rhode Island General Laws 23-6.5-2
- Quorum: The number of legislators that must be present to do business.
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Rodent: means rats, mice, and/or bats. See Rhode Island General Laws 23-7.1-3
- Self-administration: means a person's discretionary use of an epinephrine auto-injector. See Rhode Island General Laws 23-6.4-1
- State: means the government of the state of Rhode Island. See Rhode Island General Laws 23-7.1-3
- Statute: A law passed by a legislature.
- Subpoena: A command to a witness to appear and give testimony.
- Supplier: means a person from whom a lessor buys or leases goods to be leased under a finance lease. See Rhode Island General Laws 6A-2.1-103
- town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant. See Rhode Island General Laws 43-3-9

- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
