(a)  The use of a personal wireless communications device by a school bus driver shall be prohibited, while the bus is transporting children, except in the case of an emergency.

  • Conviction: A judgement of guilt against a criminal defendant.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6

(b)  Any person who violates any of the provisions of subsection (a) of this section shall, upon conviction, be punished by a fine of one hundred dollars ($100).

(c)  For a subsequent conviction under this section, a person shall be punished by a fine of one hundred fifty dollars ($150).

(d)  For a third or subsequent conviction under this section a person shall be punished by a fine of two hundred dollars ($200).

(e)  If any civil action is brought as a result of a violation of this section, the violation shall be evidence of negligence.
