  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • backfill employee: means an employee of a political subdivision who performs the duties of a mobile support unit member during the deployment of the mobile support unit member to assist another state under the Emergency Management Assistance Compact. See Indiana Code 10-14-3-0.5
  • backfill employee: has the meaning set forth in Indiana Code 10-14-4-0.3
  • broadcaster: has the meaning set forth in IC 10-13-5-2. See Indiana Code 10-14-3-0.6
  • cask: has the meaning set forth in IC 10-14-8-3(c). See Indiana Code 10-14-9-1
  • Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • communications service provider: has the meaning set forth in Indiana Code 10-14-3-0.8
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • department of homeland security: refers to the department of homeland security established by IC 10-19-2-1. See Indiana Code 10-14-3.5-0.5
  • disaster: has the meaning set forth in IC 10-14-3-1. See Indiana Code 10-14-4-1
  • disaster: means an occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from any natural phenomenon or human act. See Indiana Code 10-14-3-1
  • disaster relief organization: means an entity that provides emergency or disaster relief services that include health or veterinary services provided by volunteer health practitioners and:

  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • eligible entity: means a county, a city, a town, a township, or an individual who has incurred loss or cost because of a disaster. See Indiana Code 10-14-4-2
  • emergency: means an occurrence or condition in a jurisdiction that results in a situation:

  • emergency: means an event or condition that is an emergency, a disaster, or a public health emergency under this article. See Indiana Code 10-14-3.5-2
  • emergency declaration: means a declaration of emergency issued by a person authorized to do so under state or local laws of Indiana. See Indiana Code 10-14-3.5-3
  • emergency management: means the preparation for and the coordination of all emergency functions, other than functions for which military forces or other federal agencies are primarily responsible, to prevent, minimize, and repair injury and damage resulting from disasters. See Indiana Code 10-14-3-2
  • Emergency Management Assistance Compact: means the federal interstate compact under P. See Indiana Code 10-14-3.5-4
  • Emergency Management Assistance Compact: refers to IC 10-14-5. See Indiana Code 10-14-3-2.5
  • emergency management worker: includes any full-time or part-time paid, volunteer, or auxiliary employee of:

  • emergency responder: means a person:

  • energy: means coal, petroleum or other liquid fuels, natural or synfuel gas, or electricity. See Indiana Code 10-14-3-4
  • energy emergency: means an existing or projected shortfall of at least eight percent (8%) of motor fuel or of other energy sources that threatens to seriously disrupt or diminish energy supplies to the extent that life, health, or property may be jeopardized. See Indiana Code 10-14-3-5
  • entity: means a person other than an individual. See Indiana Code 10-14-3.5-5
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • fund: refers to the state disaster relief fund established by this chapter. See Indiana Code 10-14-4-3
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • health facility: means an entity licensed under the laws of Indiana or another state to provide health or veterinary services. See Indiana Code 10-14-3.5-6
  • health practitioner: means an individual licensed under the laws of Indiana or another state to provide health or veterinary services. See Indiana Code 10-14-3.5-7
  • health services: means the provision of treatment, care, advice, guidance, or other services or supplies related to the health or death of individuals or human populations to the extent necessary to respond to an emergency, including:

  • high level radioactive waste: means :

  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5
  • host entity: means an entity operating in Indiana that uses volunteer health practitioners to respond to an emergency. See Indiana Code 10-14-3.5-9
  • HRCQ materials: means a quantity within a single package that exceeds the least of the following:

  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • license: means authorization by a state to engage in health or veterinary services that are unlawful without the authorization. See Indiana Code 10-14-3.5-10
  • licensee: refers to an entity that is licensed by the United States Nuclear Regulatory Commission to own or use radioactive materials. See Indiana Code 10-14-8-2.3
  • local travel advisory: means the level of emergency declared under section 29 of this chapter by the principal executive officer of a political subdivision to alert the traveling public of emergency conditions that may require the imposition of travel restrictions. See Indiana Code 10-14-3-5.5
  • low level radioactive waste: means radioactive material from a facility licensed by the United States Nuclear Regulatory Commission under Indiana Code 10-14-8-2.5
  • nuclear response fund: refers to the nuclear response fund established by IC 10-14-8-6. See Indiana Code 10-14-9-4
  • Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • package: has the meaning set forth in Indiana Code 10-14-9-5
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: means an individual, a corporation, a business trust, a trust, a partnership, a limited liability company, an association, a joint venture, a public corporation, a government or governmental subdivision, an agency, an instrumentality, or another legal or commercial entity. See Indiana Code 10-14-3.5-11
  • Personal property: includes goods, chattels, evidences of debt, and things in action. See Indiana Code 1-1-4-5
  • Personal property: All property that is not real property.
  • political subdivision: has the meaning set forth in IC 36-1-2-13. See Indiana Code 10-14-3-6
  • political subdivision: has the meaning set forth in IC 36-1-2-13. See Indiana Code 10-14-6.5-3
  • Population: has the meaning set forth in Indiana Code 1-1-4-5
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • scope of practice: means the extent of the authorization to provide health or veterinary services granted to a health practitioner by a license issued to the practitioner in the state in which the principal part of the practitioner's services are rendered, including conditions imposed by the licensing authority. See Indiana Code 10-14-3.5-12
  • Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
  • spent nuclear fuel: means fuel:

  • state: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or a territory or an insular possession subject to the jurisdiction of the United States. See Indiana Code 10-14-3.5-13
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • veterinary services: means the provision of treatment, care, advice, guidance, or other services or supplies related to the health or death of an animal or to animal populations to the extent necessary to respond to an emergency, including:

  • volunteer health practitioner: means a health practitioner who provides health or veterinary services, whether or not the practitioner receives compensation for those services. See Indiana Code 10-14-3.5-15
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
