  • account: refers to the seminary lands school account established under section 8 of this chapter. See Indiana Code 20-42-3-2
  • accredited nonpublic school: means a nonpublic school that:

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
  • Contract: A legal written agreement that becomes binding when signed.
  • contractor: means a person awarded a price contract. See Indiana Code 4-13-1.6-1
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • department: refers to the Indiana department of administration established by IC 4-13-1-2. See Indiana Code 4-13-1.6-2
  • eligible student: means a child or an emancipated minor:

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • fund: refers to a common school fund administered by a county. See Indiana Code 20-42-1-2
  • fund: refers to a seminary township school fund established under section 5 of this chapter. See Indiana Code 20-42-3-3
  • fund: refers to a school safety referendum tax levy fund established under section 4 of this chapter. See Indiana Code 20-40-20-1
  • fund: refers to a congressional township school fund administered by a county. See Indiana Code 20-42-2-2
  • fund: refers to a school safety referendum debt service fund established under section 2 of this chapter. See Indiana Code 20-40-21-1
  • fund: refers to the curricular materials fund established by section 5 of this chapter. See Indiana Code 20-40-22-3
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • levy: refers to a school safety referendum tax levy imposed under IC 20-46-9 for the fund. See Indiana Code 20-40-20-2
  • major equipment item: refers to any item that a school corporation considers:

  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • price contract: refers to a contract entered into by the department under section 11 of this chapter. See Indiana Code 4-13-1.6-4
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • public school: means a:

  • school corporation: has the meaning set forth in IC 20-18-2-16. See Indiana Code 4-13-1.6-5
  • school resource officer: has the meaning set forth in Indiana Code 20-40-20-3
  • seminary land: means land dedicated to the inhabitants of a township by the Northwest Territory Ordinance of 1787 for educational purposes. See Indiana Code 20-42-3-4
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Statute: A law passed by a legislature.
  • treasurer: includes an assistant treasurer or a deputy treasurer. See Indiana Code 20-41-1-1
  • Trustee: A person or institution holding and administering property in trust.
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
