Sec. 3.3. As used in this chapter, “legal representative” means:
(2) a health care representative acting under IC 16-36-1 or IC 16-36-7;
(1) a guardian;

- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- long term care facility: means any of the following:
Indiana Code 12-10-13-3.6
(3) an attorney-in-fact for health care appointed under IC 30-5-5-16;
(4) an attorney-in-fact appointed under IC 30-5-5 who does not hold health care powers; or
(5) the personal representative of the estate;
of a resident of a long term care facility.
