Sec. 4. In accordance with 21 U.S.C. § 862a(d)(1), the state elects to opt out of the application of 21 U.S.C. § 862a(a) for individuals participating in:
(2) a program that offers individuals on probation or in a community corrections program evidence based mental health and addiction forensic treatment services administered or coordinated by a provider certified by the division of mental health and addiction to provide mental health or addiction treatment.

- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
