Sec. 1. (a) Any individual may file a
complaint against a
temporary health care services agency in writing with the
division.

Terms Used In Indiana Code 16-52-4-1
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- division: refers to the division of consumer protection created by IC 4-6-9-1. See Indiana Code 16-52-1-2
- in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
- temporary health care services agency: means a person engaged for hire in the business of providing or procuring temporary employment in health care facilities for health care personnel. See Indiana Code 16-52-1-5
(b) The division is responsible for investigating a complaint against a temporary health care services agency filed under subsection (a) in accordance with IC 4-6-9-4.5.
(c) If the division determines that a complaint is substantiated, the division shall inform the state department and the state department shall:
(1) oversee any negotiations between the parties of the complaint; and
(2) determine any proper action to take against the temporary health care services agency for a violation under this article.
