Sec. 2. As used in this chapter, “contractor” means a person that satisfies either of the following:
(A) has entered into; or
(1) Is a person that:

- Contract: A legal written agreement that becomes binding when signed.
- person: means an individual, a corporation, a limited liability company, a partnership, or another legal entity. See Indiana Code 22-5-1.7-4
- political subdivision: has the meaning set forth in IC 36-1-2-13. See Indiana Code 22-5-1.7-5
- public agency: has the meaning set forth in IC 5-30-1-11. See Indiana Code 22-5-1.7-6.2
- public works project: has the meaning set forth in IC 5-16-13-6. See Indiana Code 22-5-1.7-6.4
- state agency: has the meaning set forth in IC 4-13-1-1. See Indiana Code 22-5-1.7-7
(B) is attempting to enter into;
a public contract for services with a state agency or political subdivision.
(2) Is a person that:
(A) has entered into; or
(B) is attempting to enter into;
a contract for a public works project with a public agency.
