Sec. 4. An action to abate a nuisance under this chapter may be initiated by any of the following:
(2) The corporation counsel or city attorney of a city in which a nuisance is located.
(1) The prosecuting attorney of the circuit where the nuisance is located.
Terms Used In Indiana Code 32-30-8-4
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- nuisance: means the use of a property to commit an act constituting an offense under IC 35-48-4. See Indiana Code 32-30-8-1
- property: means a house, a building, a mobile home, or an apartment that is leased for residential or commercial purposes. See Indiana Code 32-30-8-2
(3) An attorney representing a county in which a nuisance is located.
(4) The property owner.
(5) The attorney general.
