Sec. 3. “Advance payment”, for purposes of IC 34-44-2, means a payment made:
(A) the defendant in an action to recover damages for personal injuries, wrongful death, or property damage; or
(1) by:

- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Property: includes personal and real property. See Indiana Code 1-1-4-5
(B) the defendant’s insurance company; and
(2) to or for the plaintiff or any other person.
