Sec. 9. (a) Except as provided in subsection (b), if an Indiana
law requires or allows the use of a
sworn declaration, an
unsworn declaration meeting the requirements of this chapter has the same effect as a sworn declaration.

Terms Used In Indiana Code 34-59-1-9
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- law: includes the following:

- Oath: A promise to tell the truth.
- Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
- sworn declaration: means a declaration in a signed record given under oath. See Indiana Code 34-59-1-7
- unsworn declaration: means a declaration in a signed record that is not given under oath but is given under penalty of perjury. See Indiana Code 34-59-1-8
(b) This chapter does not apply to:
(1) a deposition;
(2) an oath of office;
(3) an oath required to be given before a specified official other than a notary public;
(4) a declaration to be recorded under IC 32; or
(5) an oath required by IC 29-1-5.
