Sec. 10. (a) The department shall give a person who:

(1) is aggrieved by an order issued under section 9 of this chapter; and

Terms Used In Indiana Code 36-8-17-10

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • department: refers to the department of homeland security established by IC 10-19-2-1. See Indiana Code 36-8-17-4.5
(2) requests review of the order in verbal or written form;

an opportunity to informally discuss the order with the department. Review under this subsection does not suspend the running of the time period in which a person must petition under IC 4-21.5-3-7 to appeal the order.

     (b) The department may, on its own initiative or at the request of any person, modify or reverse an order issued under section 9 of this chapter.
