Nevada Revised Statutes 639.2813 – False representation as practitioner or agent; penalties; unauthorized transmission of order for prescription by agent
1. Except as provided in NRS 453.331 and 454.311, it is unlawful for any person falsely to represent himself or herself as a practitioner entitled to write prescriptions in this state, or the agent of such a person, for the purpose of transmitting to a pharmacist an order for a prescription. - person: means a natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. See Nevada Revised Statutes 0.039
- substantial bodily harm: means :
(a) If no substantial bodily harm results, is guilty of a category D felony; or
(b) If substantial bodily harm results, is guilty of a category C felony, and shall be punished as provided in NRS 193.130.
2. It is unlawful for the agent of a practitioner entitled to write prescriptions in this state willfully to transmit to a pharmacist an order for a prescription if the agent is not authorized by the practitioner to transmit such order.
