Terms Used In Louisiana Revised Statutes 36:109

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Office: means each principal operational unit within a department, except the executive office of the secretary. See Louisiana Revised Statutes 36:3
  • Secretary: means the officer appointed by the governor as the executive head and chief administrative officer of certain departments created and provided for by this Title. See Louisiana Revised Statutes 36:3

            A. The Board of Commerce and Industry (Article XIV, Section 14(b.2) of the 1921the Louisiana Constitution made statutory by Article XIV, Section 16(A)(10) of the 1974the Louisiana Constitution; La. Rev. Stat. 51:921 through 947; La. Rev. Stat. 47:3201 through 3205) is transferred to and hereafter shall be within the Department of Economic Development, in accordance with the provisions of La. Rev. Stat. 36:901, except that the Board of Commerce and Industry shall continue to exercise those powers, duties, and functions with respect to the granting of tax exemptions for new manufacturing establishments or extensions thereof which it is authorized by the Constitution of Louisiana or by law to exercise.

            B. The following agencies are placed within the Department of Economic Development and shall perform and exercise their powers, duties, functions, and responsibilities as provided by law:

            (1) The office of entertainment industry development (La. Rev. Stat. 51:938.1).

            (2) The office of international commerce and the Louisiana Board of International Commerce (La. Rev. Stat. 51:3131 et seq.).

            (3) The Louisiana Military Advisory Council (La. Rev. Stat. 29:61 et seq.).

            C. The Department of Commerce and Industry (La. Rev. Stat. 51:921 through 938) is hereby abolished and its powers, duties, functions, and responsibilities are transferred to the secretary of the Department of Economic Development and hereafter shall be exercised and performed as provided in La. Rev. Stat. 36:921 et seq.

            D. The Louisiana Economic Development Corporation and its board of directors (La. Rev. Stat. 51:2311 et seq.) are placed within the Department of Economic Development and shall exercise and perform their duties, powers, functions, and responsibilities in the manner provided for agencies transferred in accordance with La. Rev. Stat. 36:801.
