Terms Used In Louisiana Revised Statutes 22:1944
- Commissioner: shall mean the commissioner of insurance of this state. See Louisiana Revised Statutes 22:1942
- Residents: shall mean and include persons, partnerships, or corporations, domestic, alien, or foreign. See Louisiana Revised Statutes 22:1942
- Unfair Trade Practice Law: shall mean the law relating to unfair methods of competition and unfair and deceptive acts and practices in the business of insurance, as set out in Part IV of this Chapter, Louisiana Revised Statutes 22:1942
If, after thirty days following the giving of the notice mentioned in La. Rev. Stat. 22:1943, such insurer has failed to cease making, issuing, or circulating such misrepresentations or causing the same to be made, issued, or circulated in this state, and if the commissioner has reason to believe that a proceeding by him in respect to such matters would be to the interest of the public, and that such insurer is issuing or delivering contracts of insurance to residents of this state or collecting premiums on such contracts or doing any of the acts enumerated in La. Rev. Stat. 22:1945, he shall take action against such insurer under the Unfair Trade Practice Law.
