Terms Used In Louisiana Code of Evidence 414

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

Evidence of the nature and extent of a worker’s compensation claim or of payment of past or future worker’s compensation benefits shall not be admissible to a jury, directly or indirectly, in any civil proceeding with respect to a claim for damages relative to the same injury for which the worker’s compensation benefits are claimed or paid.  Such evidence shall be admissible and presented to the judge only.
