The provisions of the Procurement Code do not apply to contracts entered into by a local public body with a person, firm, organization, corporation, association or state educational institution named in Article 12, § 11 of the constitution of New Mexico for:

- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
A. the operation and maintenance of a hospital pursuant to N.M. Stat. Ann. Chapter 3, Article 44;
B. the lease or operation of a county hospital pursuant to the Hospital Funding Act [N.M. Stat. Ann. Chapter 4, Article 48B] ;
C. the operation and maintenance of a hospital pursuant to the Special Hospital District Act [N.M. Stat. Ann. Chapter 4, Article 48A]; or
D. the use of county buildings pursuant to Section 4-38-13.1 N.M. Stat. Ann..
