The like proceedings as are prescribed in the last two preceding sections [56-9-35, 56-9-36 N.M. Stat. Ann.] may be had whenever it shall appear to the court or judge that any person who shall have become security for any assignee in any bond given for due execution of his trust, has or is likely to become insolvent, or has removed or is about to remove from the state.
