The secretary shall appoint, with the approval of the governor, directors of the divisions as are established within the department; provided, the director of the New Mexico state police division shall be titled the “chief of the New Mexico state police”. The positions so appointed are exempt from the Personnel Act [N.M. Stat. Ann. Chapter 10, Article 9].
