A. Except in matters arising from Sections 6 [59A-18-13.3 N.M. Stat. Ann.] and 7 [repealed] of this 2011 act, a party may appeal from an order of the superintendent made after an informal hearing or an administrative hearing. The appeal shall be taken to the district court pursuant to the provisions of Section 39-3-1.1 N.M. Stat. Ann..

Terms Used In New Mexico Statutes 59A-4-20

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

B. This section shall not apply as to matters arising pursuant to N.M. Stat. Ann. Chapter 59A, Article 17.
