(a) The Chair bears the burden of proof to support his or her action or decision by a preponderance of the evidence.

- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(b) The Commission shall review the Chair’s actions or decisions de novo.
