(a) Except as provided in subsection (b) of this section, this chapter and title 11 do not affect any right to trial by jury that an individual has under applicable nonbankruptcy law with regard to a personal injury or wrongful death tort claim.
Terms Used In 28 USC 1411
- individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See 1 USC 8
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
(b) The district court may order the issues arising under section 303 of title 11 to be tried without a jury.
