Terms Used In Alabama Code 16-65A-5

  • Contract: A legal written agreement that becomes binding when signed.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • state: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Alabama Code 1-1-1

The Attorney General of Alabama, upon request of the State Treasurer, shall institute proceedings in the name of the state for the purpose of recovering any amount due the state under the provisions of this section. All proceedings involving default or dispute of the contract shall be brought in the appropriate court of jurisdiction in Montgomery County, Alabama.
