Notwithstanding the administrative procedure provided in subsections (a), (b), and (c) of Section 22-37A-7, the board may institute proceedings for assessment of a civil penalty in the Circuit Court of Montgomery County, or in the circuit court of the county in which all or part of the violation occurred.
